Police move HC to cancel bail of Birch nightclub owners

In a fresh development in the December 2025 fire at Birch by Romeo Lane that claimed 25 lives, Goa Police on Wednesday approached the High Court of Bombay at Goa seeking cancellation of the bail granted to nightclub owners Gaurav and Saurabh Luthra and their business partner Ajay Gupta.

The Vacation Bench of Justice Ashish Chavan issued notices to the three accused and posted the matter for hearing on June 15.

Police have sought cancellation of the Luthra brothers’ bail in both the fatal fire case and the alleged no-objection certificate forgery case linked to the nightclub.

The brothers are facing charges of negligence, endangering human life and other offences in connection with the blaze that swept through Birch by Romeo Lane on December 7, 2025. The Mapusa court had granted them bail last month.

Ajay Gupta, who had earlier claimed he was not an owner of the premises but only a sleeping partner, was granted bail in March. Police have also sought cancellation of his bail.

A chargesheet has already been filed naming 13 accused, including the Luthra brothers. Police have alleged gross criminal negligence, disregard for human life and failure to comply with mandatory safety norms at the nightclub.
